Marking of Commodities — s. 9(1)
No trader shall sell, offer for sale or have in their possession
for sale on the basis of number or measure any commodity, unless
its quantity is stated accurately within prescribed limits of
error and in the manner prescribed in terms of number or units of
measurement of length, area, volume or capacity, or mass or weight
on the following items, as may be prescribed:
- (a) the commodity;
- (b) the package containing the commodity; or
-
(c) a shipping bill, bill of lading or other document
accompanying the commodity.
Offences and Punishment — s. 33(1)
Every person who sells or offers for sale any commodity, by number
or unit of measurement, is guilty of an offence if the quantity of
the commodity that that person delivers or offers for sale is,
subject to prescribed limits of error, less than the quantity that
that person
- (a) purports to sell or offer for sale; or
-
(b) should deliver or offer for sale on the basis of
-
(i) the total price paid or to be paid for the commodity,
and
-
(ii) the stated price per number or unit of measurement.

Manner of Showing Statement of Quantity — s. 47(b)
A commodity that is sold or offered for sale on the basis of
number or measure shall show a statement of quantity … in the case
of a commodity that is not packaged before being offered for sale,
on a part of the commodity itself that is visible to the purchaser
under normal or customary conditions of sale or use or on a
shipping bill, bill of lading or other document accompanying the
commodity.
Limits of Error — s. 49(1)
Subject to subsection (2), the prescribed limits of error for the
purposes of sections 9 and 33 of the Act are those set out in
Column II of an item of the appropriate Part of Schedule II for
the stated quantity set out in Column I of that item.
